Status: The House Committee on the Judiciary advanced the bill by a vote of 24-20. 


The “American Choice and Innovation Online Act would make it unlawful for a person operating a dominant platform to engage in discriminatory conduct, including self-preferencing and picking winners and losers online. In addition, the bill gives the FTC, DOJ, and state attorneys general enforcement authority, and it introduces a private right of action. In instances where a conflict of interest exists, the bill would also authorize the court to consider divestiture.
