Description
The “Banning Microtargeting Political Ads Act of 2021” would amend the Federal Election Campaign Act of 1971, prohibiting online platforms (i.e., social media, ad networks, and streaming services) from targeting political advertisements based on users’ demographic or behavioral data.
Violations will be enforced by the Federal Election Commission and through a private right of action. Targeting ads to recognized geographies—such as states, municipalities, and districts—would be permitted, while targeting by narrow geographies would not. Opt-in, consent-based advertising would also be permitted.
