The “See Something, Say Something Online Act” amends Section 230 of the Communications Decency Act to require online platforms to report suspicious activities to law enforcement through a new clearinghouse within the Justice Department. Platforms that fail to comply risk being held liable for transmitting suspicious content. The bill also states that, should online platforms “fail to exercise due care in the implementation, filing of the suspicious transmission activity reports, and reporting of major crimes” (e.g., illegal drug sales, hate crimes, murder, or terrorism), Congress will consider removing the legal shield altogether.
